Credit Reference Agency Must Delete Data of an Insolvency Debtor

Credit reference agencies must not process the data of an insolvency debtor for longer than the information may be published in the official insolvency announcements portal.The decision of the higher regional court of Schleswig Holstein was based on insolvency proceedings opened in 2020. The proceedings were terminated by order of the local court and this information was published in the insolvency announcements portal. The claimant sought deletion of the data because of the economic and financial disadvantages he suffered. The credit reference agency refused the claim and relied on a period of three years. The regional court of Kiel dismissed the action.On appeal, the higher regional court of Schleswig Holstein decided on 3 June 2022 that the data of an insolvency debtor must be deleted by the credit reference agency after six months.In the proceedings the interest of the credit reference agency in obtaining credit relevant information was weighed against the interest of the insolvency debtor in being able to participate in economic life without restrictions. This had not been possible before the information on the insolvency proceedings was deleted from the insolvency announcements portal. The court had to carry out a detailed balancing of these conflicting interests. It held that once six months had expired, the interest of the credit reference agency in continuing to process the data was outweighed by the interest of the insolvency debtor.
