If the declaration of division also contains rules on the allocation key for advance payments for operating costs, these rules are binding for the condominium owners association. This means that the association may not depart from the rules in the declaration of division by resolutions on financial plans.Facts:The claimants brought an action against a resolution on the financial plan of the condominium owners association, in which it was stipulated that the cost allocation for advance payments for water and heating would be distributed proportionally according to the size of the living areas. The reason for challenging this resolution was that the declaration of division stipulated that the advance payments for heating and water were to be calculated 50 percent based on the size of the living areas and 50 percent based on actual consumption.Decision:The regional court of Berlin allowed the claim and held that the claimants were right. According to the court, a resolution that deviates from the rules in the declaration of division does not comply with proper administration and must therefore be declared invalid. The cost allocation is determined by the relevant allocation key. The condominium owners association has no discretion in relation to cost allocation. The allocation key in the declaration of division is mandatory and binding. On the basis of these considerations the regional court of Berlin declared the resolution invalid.
