No Change in the Insolvency Ranking Due to the Occurrence of New Estate Insolvency

The decision of the Federal Labour Court of 25 August 2022 concerned the insolvency ranking of claims for default of acceptance of work and the occurrence of new estate insolvency notified by the insolvency administrator during the insolvency proceedings. At the time of opening of the insolvency proceedings the defendant insolvency administrator notified imminent insufficiency of the assets to cover the costs pursuant to section 208 paragraph 1 of the Insolvency Code, and subsequently relied first on estate insufficiency and later on new estate insufficiency.The Federal Labour Court reaffirmed its settled case law and clarified that the Insolvency Code is exhaustive and therefore provides for only one ranking order. There is no downgrading of new estate liabilities as defined in section 209 paragraph 1 number 2 of the Insolvency Code in the event of a renewed insufficiency of the assets. Notifications of estate or new estate insufficiency by the insolvency administrator therefore have no binding effect in the sense of section 208 paragraph 1 of the Insolvency Code. Alongside these positive aspects for insolvency administrators, the judgment also creates procedural obstacles. As already required by the regional labour court, the Federal Labour Court also held that an insolvency administrator must set out and prove the occurrence of estate insufficiency in court proceedings.
