No right to reemployment in insolvency (Federal Labour Court, judgment of 25 May 2022, docket number 6 AZR 224/21)The Federal Labour Court recently held that in the event of insolvency of the employer the employee has no right to be reemployed.The judgment of the Federal Labour Court concerned a closure of business and the associated valid termination of the claimant’s employment. The future defendant, who was to operate the new business, issued a precautionary notice of termination to the claimant, which he challenged by bringing an action for protection against dismissal. Under the previous case law of the highest courts this action would basically have had prospects of success. According to that case law, an employee has a right to be reemployed if the employer’s initially correct prognosis at the time of receipt of the notice of termination regarding the lack of need for employment after a transfer of business later proves to be incorrect. In the case of a transfer of business, employees generally have the right to be taken over by the transferee.In the present case, however, insolvency proceedings were opened in respect of the defendant. The Federal Labour Court held that the employee’s right to be reemployed lapses if insolvency proceedings are opened in respect of the transferee. In such an insolvency case there is no right to reemployment.
